2. Website Use
This website is provided for informational, portfolio, booking, and communication purposes. You may use this website to view photography work, learn about available services, request a quote, book a session, or contact Jonathan Carrasco Photo.
You agree not to misuse this website, interfere with its operation, attempt unauthorized access, copy website content for commercial use, or use the website in a way that violates applicable laws.
3. Photography Services
Jonathan Carrasco Photo offers photography services including, but not limited to, automotive photography, portrait photography, professional headshots, family photography, maternity photography, engagement photography, commercial photography, brand photography, and related creative services.
All services, pricing, deliverables, timelines, usage rights, deposits, payment schedules, cancellation terms, and project expectations may vary depending on the specific session or project. Any custom quote, invoice, proposal, contract, or written agreement provided for a specific project will control over general information shown on this website.
4. Quotes and Booking Requests
Submitting a quote request or booking inquiry through this website does not guarantee availability, pricing, or acceptance of the project. A session is not considered booked until Jonathan Carrasco Photo confirms the booking and any required deposit, retainer, invoice, or agreement has been completed.
Quotes are based on the information provided by the client. If the project scope changes, including location, timing, deliverables, commercial usage, number of people, number of vehicles, additional editing, travel, or production needs, pricing may be adjusted.
5. Payments, Deposits, and Retainers
Photography sessions may require a deposit, retainer, or partial payment to reserve the date and time. Unless otherwise stated in a written agreement, deposits or retainers are used to secure availability and may be non-refundable once the session is booked.
Final payment terms will be provided in the applicable quote, invoice, proposal, contract, or written agreement.
Jonathan Carrasco Photo reserves the right to pause, delay, or withhold delivery of final images, galleries, downloads, prints, or usage permissions until all required payments are received.
6. Rescheduling and Cancellations
Rescheduling may be allowed depending on availability, weather, emergency circumstances, project type, and timing of notice. Cancellation and rescheduling terms may vary by project and will be addressed in the applicable quote, invoice, contract, or written agreement.
For outdoor sessions, Jonathan Carrasco Photo may recommend rescheduling due to unsafe weather, poor conditions, lighting issues, or circumstances that would materially affect the quality or safety of the session.
7. Client Responsibilities
Clients are responsible for providing accurate contact information, arriving on time, securing any required permissions for private locations, communicating session goals clearly, and ensuring that all participants are aware of the session details.
For automotive sessions, clients are responsible for vehicle readiness, cleanliness, safety, legal operation, and any required drivers, locations, or permissions unless otherwise agreed in writing.
For commercial, brand, event, or production-related projects, the client is responsible for securing necessary permissions, releases, location access, talent approvals, brand approvals, property permissions, and other project-specific clearances unless otherwise agreed in writing.
8. Copyright Ownership
Unless otherwise agreed in a separate written agreement signed by Jonathan Carrasco Photo, all photographs, images, edits, creative works, and related visual materials created by Jonathan Carrasco Photo remain the intellectual property of Jonathan Carrasco Photo.
Clients do not receive copyright ownership simply by booking a session, paying for photography services, receiving a gallery, downloading images, or purchasing prints.
Any transfer of copyright, exclusive license, commercial license, advertising license, publication license, brand usage license, or work-made-for-hire arrangement must be stated clearly in a separate written agreement.
9. Personal Use License
For standard personal sessions, clients generally receive a limited personal-use license to download, share, print, and enjoy the final delivered images for personal, non-commercial purposes.
Personal use may include sharing images with family and friends, posting images on personal social media accounts, printing images for personal display, and keeping images for personal records.
Unless otherwise agreed in writing, personal-use images may not be sold, licensed, entered into paid advertising, used for business promotion, used for merchandise, submitted to publications for commercial purposes, modified for resale, or transferred to third parties for commercial use.
10. Commercial Use and Brand Licensing
Commercial use is not included unless specifically stated in writing.
Commercial use may include, but is not limited to, advertising, paid social media campaigns, website marketing, product promotion, album covers, magazine submissions, brand campaigns, merchandise, sponsorship content, press kits, dealership marketing, business promotion, influencer monetization, editorial publication, or licensing to third parties.
Commercial usage rights must be negotiated and documented separately. Fees may vary based on usage type, duration, territory, exclusivity, media placement, brand size, distribution, and production scope.
No commercial license, copyright transfer, exclusivity, or ownership transfer is granted unless it is clearly included in a written agreement.
11. Editing, Alterations, and Image Integrity
Final images are delivered according to Jonathan Carrasco Photo’s editing style and professional judgment. Clients may not materially alter, heavily filter, edit, crop in a misleading way, remove watermarks, use artificial intelligence to modify, or misrepresent final images without written permission.
Minor cropping for social media display is generally acceptable, provided the image is not altered in a way that damages the quality, misrepresents the work, or creates a false impression.
12. Portfolio, Website, and Promotional Use
Unless otherwise agreed in writing, Jonathan Carrasco Photo may use images from sessions for portfolio, website, social media, promotional, advertising, print, editorial, contest, and business-development purposes.
If a client requires privacy, confidentiality, delayed posting, non-disclosure, or restricted usage, that must be requested and agreed to in writing before the session.
For sensitive projects, private events, minors, commercial campaigns, unreleased vehicles, confidential brands, or celebrity-related work, specific usage restrictions should be documented in a separate written agreement.
13. Client Galleries and Image Delivery
Final images may be delivered through Pixieset, digital gallery, Google Drive, Dropbox, WeTransfer, or another delivery method selected by Jonathan Carrasco Photo.
Gallery availability, download windows, storage duration, file types, print options, and delivery timelines may vary. Clients are responsible for downloading and safely storing their final images before any gallery expiration date.
Jonathan Carrasco Photo is not responsible for long-term storage of galleries or images after delivery unless otherwise agreed in writing.
14. Prints, Products, and Third-Party Vendors
Prints, albums, merchandise, or other physical products may be fulfilled directly or through third-party vendors. Product availability, pricing, shipping timelines, color accuracy, paper type, framing, and fulfillment terms may vary.
Jonathan Carrasco Photo is not responsible for delays caused by third-party labs, shipping providers, payment processors, or fulfillment vendors.
15. Testimonials and Reviews
If a client provides a testimonial, review, message, comment, or feedback, Jonathan Carrasco Photo may use that feedback for marketing, website, social media, or promotional purposes unless the client requests otherwise in writing.
Testimonials may be edited for length or clarity, but the meaning will not be intentionally misrepresented.
16. Limitation of Liability
To the fullest extent permitted by law, Jonathan Carrasco Photo is not liable for indirect, incidental, consequential, special, punitive, or lost-profit damages arising from website use, booking inquiries, photography services, image usage, third-party platforms, delivery delays, technical issues, or client use of delivered images.
Jonathan Carrasco Photo’s total liability for any claim related to a photography session, website use, quote, invoice, or service shall not exceed the amount paid by the client for the specific service giving rise to the claim, unless otherwise required by law.
17. No Guarantee of Results
Jonathan Carrasco Photo aims to provide high-quality photography and a professional client experience. However, no specific business result, social media result, publication result, sales result, sponsorship result, engagement result, or marketing outcome is guaranteed.
18. Third-Party Links and Platforms
This website may link to or use third-party platforms, including but not limited to Squarespace, Pixieset, Google, payment processors, social media platforms, analytics tools, gallery delivery tools, or file transfer services.
Jonathan Carrasco Photo is not responsible for the content, security, privacy practices, outages, errors, or policies of third-party platforms.
19. Changes to These Terms
Jonathan Carrasco Photo may update these Terms of Service from time to time. The updated version will be posted on this page with a revised “Last Updated” date.
Continued use of the website after updates means you accept the revised Terms.
20. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any disputes related to these Terms, this website, or photography services shall be handled in the appropriate courts located in California, unless otherwise required by law or agreed in writing.
